Terms and Conditions

1. Scope of Application

These Terms and Conditions apply to all contracts concluded between Maria Luisa Engels, Königsteiner Straße 85, 65812 Bad Soden am Taunus, Hessen, Germany, email: [email protected], and consumers purchasing digital self-paced online courses through this website or related checkout pages.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

2. Subject Matter of the Contract

The subject matter of the contract is the sale of digital content in the form of self-paced online courses and any related course materials provided as part of the purchased course.

3. Conclusion of Contract

The presentation of courses on the website does not constitute a legally binding offer, but an invitation to place an order.

By completing the checkout process and clicking the order button, the customer submits a binding offer to purchase the selected course.

The contract is concluded upon acceptance of the order by confirmation email, payment confirmation, or by granting access to the purchased course, whichever occurs first.

4. Payment

The course fee is due upon conclusion of the contract unless otherwise agreed.

Payment is processed via Stripe or the payment methods offered through Stripe at checkout.

Access to the purchased course is granted only after receipt of payment, unless otherwise agreed.

If instalment payment is offered for a course, access shall be granted after receipt of the first instalment.

The second instalment shall be due on the agreed date.

If the second instalment is not received within 5 working days after it becomes due, access may be suspended until full payment has been received.

Payments already made shall not be refunded if access is suspended due to non-payment.

6. Delivery and access period

The purchased course is delivered digitally by granting access to the online course area.

Depending on the course, access shall be provided for 6 months or 1 year from the date of purchase, as specified in the respective offer.

After expiry of the applicable access period, access to the course content shall be removed.

7. Right of Use

Upon payment, the customer receives a simple, non-exclusive, non-transferable right to use the purchased course content for personal use only.

The customer is not permitted to copy, reproduce, distribute, share, publicly make available, sell, sublicense, or otherwise exploit the course content or any part of it beyond the legally permitted scope without prior written consent.

Access data may not be shared with third parties.

8. Withdrawal right

For contracts for the supply of digital content not supplied on a tangible medium, the consumer’s right of 14 days of withdrawal shall expire if the trader has begun performance of the contract after the consumer has expressly agreed that performance shall begin before the expiry of the withdrawal period and has acknowledged that, by giving such consent, the consumer loses the right of withdrawal upon commencement of performance.

This applies in particular where the customer receives immediate access to the purchased course directly after purchase.

At checkout, the customer must expressly request immediate access to the digital content before expiry of the 14-day withdrawal period and acknowledge that the right of withdrawal is lost once performance begins.

Because access is granted immediately after purchase, the right of withdrawal expires once performance has begun, pursuant to Section 356(5) BGB.

9. No Guarantee of Success

No specific learning outcome, business result, financial result, or individual success is owed.

Course content is provided for educational and informational purposes. The implementation of the content and any results achieved remain the sole responsibility of the customer. Maria Luisa Engels shall not be liable if the customer does not achieve the expected results.

10. Customer Obligations

The customer shall provide truthful and complete information during the ordering process.

The customer shall refrain from any misuse of the website, customer account, or course platform, including unauthorized access attempts, sharing of access credentials, and unlawful use of course materials.

11. Intellectual Property

All course content, videos, texts, worksheets, graphics, concepts, methods, branding, and other materials made available in connection with the course are protected by copyright and other intellectual property rights.

The customer may use the course content for personal use only and may not copy, share, reproduce, or resell it.

No rights are transferred to the customer except the limited right of use expressly granted under these Terms and Conditions.

12. Liability

Maria Luisa Engels shall be liable without limitation for intent and gross negligence and to the extent required under mandatory statutory provisions.

In cases of slight negligence, liability shall be limited to the breach of essential contractual obligations, that is, obligations whose fulfillment is necessary for the proper performance of the contract and on whose observance the customer may regularly rely. In such cases, liability shall be limited to the foreseeable, typical damage.

Any further liability is excluded to the extent permitted by law.

13. Consumer Dispute Resolution

Maria Luisa Engels is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board unless mandatory law requires otherwise.

14. Governing Law

The law of the Federal Republic of Germany shall apply.

If the customer is a consumer and has their habitual residence in another country, the mandatory consumer protection provisions of that country remain unaffected.

15. Place of Jurisdiction

If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising out of or in connection with this contractual relationship shall be the registered office of Maria Luisa Engels, to the extent legally permissible.

16. Severability

If any provision of these Terms and Conditions is or becomes invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected.
